What Are The Rules And Regulations To Have A Beach With Fence?
Jacksonville area beaches have to comply with regulations, especially those located seaward of the CCCL – Coastal Construction Control Line. These CCCL regulations are in place to protect the beach, as well as the dune system, coastal wildlife and beach access areas.
For sand fences specifically, they must be installed as individual segments – or spurs – and not a continuous line. Each spur cannot exceed 10 feet in length and 4 feet in height. They must also be spaced at least 7 feet apart and aligned diagonally facing the wind. Additionally, only one row of a beach fence is allowed within sea turtle nesting habitat.
Sand fences must be of low impact, breakaway construction and biodegradable materials when possible, including the use of untreated wood and have a 40% open space to 60% solid ratio or a maximum of 50% open space between slats for most effective sand trapping. Posts are recommended to be 3-inch diameter round, untreated wood poles embedded a minimum of 3-feet deep.
What Other Restrictions Must Be Complied With To Have A Beach With Fence?
If your property is seaward of the CCCL, you must obtain a permit from the Florida Department of Environmental Protection (FDEP) for any construction, including fences. Furthermore, a current property survey is required to indicate the proposed location of the beach fence.
Note that specific guidelines exist for sand fences intended to trap sand on the beach. Additionally, if your property is within an HOA Homeowners Association neighborhood, you likely need approval before installing a fence. If you do, remember to include a fence proposal, property survey with marked fence location, and possibly a review fee, if required.
Beach With Fence Height Regulations
- For your Front Yard, the maximum fence height is 4 feet within the front yard setback.
- For Side and Rear Yards, beach fences can be up to 8 feet tall beyond the front yard setback, allowing for privacy.
- For beach fences exceeding 6 feet in height, at least 25% of the area between 6 feet and 8 feet must allow for airflow.
